SeedVac-Warranty

Seller warrants buyer that new Christianson Systems, Inc. (CSI) equipment, manufactured by it and bearing its name, shall be free from defects in material and workmanship under normal use and service (as determined by the manufacturer) for a period of one year from the date of delivery (90 days on warranted spare parts and accessories). Should any equipment or part of such equipment sold hereunder prove to be defective in material or workmanship within said period, and be returned to the manufacturer's factory no later than fifteen days after the expiration date of the warranty, transportation charges prepaid by the Buyer, and upon examination be found to be defective, such part will be replaced at the factory by the manufacturer free of charge. No warranty shall apply to any equipment or parts of such equipment worn-out through normal usage or misuse (as determined by the manufacturer). No warranty shall apply to any of the following conveying line components worn-out through normal usage or misuse (as determined by the manufacturer): all flexible hose (galvanized, stainless steel, rubber, plastic), elbows, nozzles, straight pipe, cyclones, and conveying line couplings or adaptors of any type or size.

Neither Seller nor manufacturer shall be under further liability with respect to such warranty. Buyer shall be responsible for the payment of duties or taxes on warranty parts, if applicable. The Seller or manufacturer shall be under no liability because of normal wear and tear or operation or misuse or maintenance contrary to the manufacturer's official operator's manual.

This warranty shall not apply, and neither the Seller nor Christianson Systems, Inc. shall have any liability under it or otherwise if the repairs, alteration or replacements have been made to the SEED VAC™ bulk seed conveyor other than by Seller or Christianson Systems, Inc. or its authorized agents or employees.

SeedVac™ BULK SEED CONVEYORS ARE COVERED UNDER WARRANTY ONLY IF USED FOR THE CONVEYANCE OF THE FOLLOWING PRODUCTS APPROVED BY CSI: Clean and new: Seed Corn, Soybeans, Wheat, Barley, Oats, Flax, Rye, Sorghum, Milo and Rapeseed. CONVEYANCE OF ANY OTHER PRODUCTS WITH SEED VAC BULK SEED CONVEYOR WILL VOID THE WARRANTY UNLESS WRITTEN APPROVAL HAS BEEN GRANTED BY CHRISTIANSON SYSTEMS, INC.

ANY AND ALL SEED DAMAGE ASSOCIATED OR CONNECTED WITH THE USE OF A SeedVac™ BULK SEED CONVEYOR IS THE SOLE RESPONSIBILITY OF THE BUYER.

SeedVac™ bulk seed conveyors are designed to convey only non-chemical and/or non-treated seeds. If chemically treated seeds are conveyed, SeedVac™ user(s) assume all responsibility and any and all liability associated with conveying chemically treated seeds, and must:

• ALWAYS READ AND FOLLOW ALL CHEMICAL / SEED MANUFACTURER'S SAFETY AND HANDLING INSTRUCTIONS.

• ALWAYS USE ALL APPROPRIATE SAFETY PRECAUTIONS AND EQUIPMENT, ACCORDING TO CHEMICAL / SEED MANUFACTURERS INSTRUCTIONS.

• ALWAYS READ AND FOLLOW ALL APPLICABLE DIRECTIONS, RESTRICTIONS, AND PRECAUTIONS ON THE CHEMICAL / SEED MANUFACTURERS LABELS AND SAFETY GUIDELINE INFORMATION.

Power units, electrical components, batteries, or any other items not manufactured by Christianson Systems, Inc. are warranted by their respective manufacturers.

Neither Seller nor manufacturer extends warranty, express or implied, as to description, quality, productiveness or any other matter, and the purchaser hereby waives the right to refuse and return the goods which is usually connected with non-warranty.

The CSI Delivery Form must be signed, dated, and returned to CSI within 10 days of date of delivery to validate this warranty.

LIMITATION OF WARRANTY

THE FORGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTY, WHETHER WRITTEN, ORAL OR IMPLIED (INCLUDING BUT NOT LIMITED TO A WARRANTY OF MERCHANTABILITY OR FITNESS FOR THE PURPOSE). SELLER'S LIABILITY ON ANY CLAIM OF ANY KIND INCLUDING NEGLIGENCE, FOR LOSS OF DAMAGE ARISING OUT OF, CONNECTED WITH OR RESULTING FROM THE ORDER, OR FROM THE PERFORMANCE OR BREACH THEREOF, OR FROM THE MANUFACTURE, SALE, DELIVERY, RESALE, REPAIR OR USE OF ANY GOODS COVERED BY OR FURNISHED UNDER AN ORDER SHALL IN NO CASE EXCEED THE PRICE ALLOCABLE TO THE GOODS OR PART THEREOF WHICH GIVES RISE TO THE CLAIM. IN NO EVENT SHALL SELLER OR CSI BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGES.

THIS WARRANTY IS NON-TRANSFERABLE.
